President Buhari know he will lose 2019 election if he assents to the electoral bill - Wike

- Governor Nyesom Wike called on President Buhari to sign the electoral bill

- The Rivers governor said not signing the bill could cause tension during the election

- He said the Buhari will lose the 2019 elections if the bill is signed

Governor Nyesom Wike of Rivers state has said the President Muhammadu Buhari’s withdrawal of assent to the amended electoral act is a threat to Nigeria’s existence.

Leadership reports that the Rivers governor made this claim when the Bishop of Niger Delta North, Church of Nigeria (Anglican Communion), Rt. Rev. Wisdom Ihunwo visited him at Government House in Port Harcourt.

Wike said the refusal of the president to sign the bill would generate political tension in 2019.

He said: “This present administration does not want the existence of one Nigeria. We don’t know if there will be Nigeria after the 2019 General elections.

“The National Assembly tried to cure the defects of the Electoral Act that led to controversies during the 2015 elections. After the passage, the President kept on giving countless excuses why he wouldn’t sign the amended Electoral Act.

“The whole essence of not signing the Electoral Act is to rig the 2019 General elections. And in the plot to rig the 2019 elections, Rivers State comes first and Akwa Ibom State is the second on their list.”

The Rivers governor claimed President Buhari is aware that if he assents to the bill, he would lose the 2019 election.

“Now, they don’t want to use the smart card readers because they want to sit down and write results.

“It is painful that the President that says he is fighting corruption is leaving room for the rigging of the 2019 polls. There is no corruption worse than rigging. The President cannot set this country on fire”.

He called on all Nigerians to join in rescuing the country\s democracy.

Meanwhile, Senator Ovie Omo-Agege, representing Delta central, has said the ECOWAS protocol on democracy and good governance forbids President Buhari from signing the Electoral Act (Amendment) Bill.

According to him, Article 2 of the protocol forbids member countries from making “substantial modification” to their electoral laws less than six months to elections “except with the consent of a majority of political actors.”

Omo-Agege, who is a staunch supporter of the president, noted that with the elections less than three months away, signing the bill would violate the ECOWAS instrument.

This has been due to her decision not to reveal the faces of her children in photos she has been posting on social media.

Proscribe IMN, its members - Rights group tells AGF

- A rights group has called for the proscription of the Islamic Movement in Nigeria

- The group gave a 72-hours ultimatum to the Attorney General of the Federation on the matter

- In its petition, the Global Integrity Crusade Network (GICN) said it has observed with disenchantment how members of IMN

A pro-democracy and civil rights group in Nigeria has threatened court action against the Attorney-General of the Federation and Minister of Justice, Abubakar Malami, if he fails to proscribe and declare the Islamic Movement (IMN) as a terrorist organization within 72 hours.

The Global Integrity Crusade Network (GICN) said it has observed with disenchantment how members of IMN known as Shiites have continued to breach national peace, cause mayhem and making life unbearable for innocent citizens.

In a petition signed by Akan Eneji, the director of research and evaluation to the AGF, the rights group said, there is no gainsaying the fact that IMN is not a registered organization at the Corporate Affairs Commission under Part C of the Companies and Allied Matters Act, CAP C20, Laws of the Federation of Nigeria, 2004, which implies that it cannot be sued or tried as an entity for crimes committed by its members.

Emoji said from evidence made available to the Judicial Commission of Inquiry set up by the Kaduna state governor Nasir El-Rufai, to look into the clash that occurred between IMN and the Nigerian Army between 12th and 14th December, 2015, IMN has never ceased to be a violent organization.

He said the December 2015 clash with the convoy of the Chief of Army Staff, Tukur Buratai led to a subsequent military operation which uncovered cache of arms and ammunition purported to have been procured by IMN with the backing of one of the foreign Islamic Republics.

The petitio read in part: "Being the foregoing as it may, a careful reading of the combined provisions of Terrorism (Prevention) Act, 2011 and Terrorism (Prevention) (Amendment) Act, 2013 establishes that IMN by its activities and characters ought to be proscribed and designated as a terrorist group just like Boko Haram and Indigenous People of Biafra (IPOB). For purposes of clarity, we have identified the many infractions committed by IMN since it came into existence in Nigeria to wit; Acts of Terrorism: Section 1 Subsection (1) of the Terrorism (Prevention) (Amendment) Act, 2013 prohibits all acts of terrorism and financing of terrorism while Section 1 Subsection (2) of the Act prescribes a maximum of death sentence for any person or body corporate who willingly commits an offence relating to terrorism either directly or indirectly within or outside Nigeria".

"There are overwhelming evidence contained in the report of the Kaduna Judicial Commission of Inquiry to show that IMN is law unto itself. As it happened in the Federal Capital Territory Abuja recently, members of IMN are fond of confronting law enforcement agencies in order to rescue any of its members arrested or kept in custody in connection with acts of terrorism.

This is a blatant breach of Section 6 the Terrorism (Prevention) (Amendment) Act, 2013 and the offence attracts imprisonment for a term not less than 20 years.

"Sir, we submit that the above infractions are substantial enough to nail IMN as a terrorist group without much ado. As the situation stands, the refusal of the Attorney-General of the Federation and Minister of Justice to proscribe IMN all along has contributed to the spread of terrorism in Nigeria.

READ ALSO: Soyinka reacts to Buhari being cloned, laments stolen identity

We are at a loss as to why the Attorney-General of the Federation and Minister of Justice neither utilized the final report of the Kaduna Commission of Inquiry nor set up another panel to fully deal with an issue as sensitive as IMN at the national level even though he has the power to do so under our laws.

"It is on record that the leadership of IMN and thousands of its followers have been jailed a number of times, but they remain adamant about converting Nigeria to an Islamic State at all cost. Unless and until the government develops the courage to tackle the excesses of El-Zakzaky and the confrontational, un-cordial, dramatic and deadly IMN at once, the much anticipated peace in Northern-Nigeria as a whole will remain a mirage.

The contribution of President Muhammadu Buhari led administration to the anti-terror efforts to make Nigeria safe again is quite commendable and must be sustained no matter whose ox is gored.

"We therefore give the Attorney General of the Federation and Minister of Justice 72 (Seventy Two) hours ultimatum from the date hereof to activate the necessary statutory procedures with a view to proscribing IMN for setting up or pursuing acts of terrorism.

In the event that this ultimatum expires without any positive actions taken, we shall not hesitate to drag the Attorney-General of the Federation and Minister of Justice being the Chief Law Officer of Nigeria to a court of competent jurisdiction in order to compel him to do the needful in the interest of peace, national security and safety of innocent citizens who now live in fear of IMN," the petition.

- The PDP presidential candidate, Atiku Abubakar, and some other candidates were absent at the event, claiming they were not invited

A former head of state and chairman of the National Peace Committee, Abdulsalami Abubakar, has that the committee invited all political parties to the peace accord signing by presidential candidates ahead of the 2019 elections on Tuesday, December 11.

This is contrary to the claim by the candidate of the Peoples Democratic Party (PDP), Atiku Abubakar, that he was not invited to the event.

Premium Times reports that Atiku and other presidential candidates such as Omoyele Sowore of the AAC, and Oby Ezekwesili of ACPN had all said they were not invited.

However, in a short interview with journalists at the International Conference Centre, Abuja, venue of the event, Abubakar insisted that all the candidates were invited.

Specifically reacting to Atiku’s claim, Abubakar said: “You have seen the number of parties that have been invited. He will answer for himself but speaking for the National Peace Committee, everybody was invited. What reasons do we have not to invite somebody? This accord was for all political parties to sign to be of goodwill and good behaviour during elections. If there is a breakdown of communications somewhere I don’t know."

Abubakar mentioned that he was surprised by Atiku’s absence.

“What surprises me is that when we had the conference with the political parties he came out and agreed on this agenda, the parties agreed and it was the recommendation that the peace committee has taken,” he said.

The former head of state, however, expressed confidence that Atiku’s absence at the event will not weaken the accord. He added that there is still room for the absent candidates to sign the peace accord.

National Assembly crafted Electoral Bill to sink Nigeria’s democracy - North central group alleges

$

Following the growing controversy over the rejection of the Electoral Act Amendment Bill by President Muhammadu Buhari, a north central group has alleged that the bill was crafted by some members of the National Assembly to sink the nation’s flourishing democracy.

The group, North Central Democracy and Peace Vanguard, accused the National Assembly of a ‘plot’ against the country.

Addressing journalists in Abuja on Monday, December 10, the group’s national president, Gabriel Agibi, said that Nigerians will hold the lawmakers solely responsible for any untoward development in the polity.

Agibi said the insistence on using "a faulty Electoral Law for the conduct of the election" by the National Assembly is a major trigger to foment trouble and cause widespread violent protests across Nigeria.

READ ALSO: NAIJ.com upgrades to Legit.ng: a letter from our Editor-in-Chief Bayo Olupohunda

The group at the briefing called on well-meaning Nigerians condemn the alleged attempt by members of the National Assembly and the opposition to derail Nigeria's democracy through the manipulation of the Constitutional provisions.

Agibi said: “That Nigerians occupy the National Assembly until their representatives in the National Assembly cease and desist from using the Electoral Act Amendment to heat up the polity. There are pressing matters deserving the attention of parliamentarians other than being the hired routs of the opposition."

“That the National Assembly immediately ceases this evil plot against the country. Should the lawmakers persist on this destructive path, Nigerians will hold them solely responsible for any untoward development in the polity," Agibi said.

“President Buhari immediately takes measures to safeguard the country against any breakdown in law and order in the country since this is the end game that the plotters are banking on to destabilize our democracy.

“That the Independent National Electoral Commission goes ahead to manage the 2019 General Election with the same law with which it began the process irrespective of whatever other criminality gets thrown its way in the form of a vetoed legislation.

The judiciary exists for situations like this so INEC must seek interpretation up to the Supreme Court before it can manage the elections with two sets of law.

“We make the above demand because it has become increasingly clear to us that the Vice President, Professor Yemi Osinbajo, our own brethren is the target. The objective is to shove the government aside and get rid of him in the process so that the number two position can go to another region while the north continues as number one position," he added.

2019 elections peace accord: World is watching us - Buhari

- Stakeholders have been urged to work towards successful and peaceful conduct of the 2019 elections

- President Buhari who made the call said the world is watching to see how Nigeria would uphold and strengthen its democracy

- He said that the conduct of elections had been consistently marred by violence caused by the behaviour of the most sections of the political class

President Muhammadu Buhari on Tuesday, December 11, implored all stakeholders to work towards successful and peaceful conduct of the 2019 elections.

Buhari made the call in Abuja at the signing of peace accord by the presidential candidates of all the political parties ahead of the 2019 elections under the aegis of National Peace Committee (NPC).

According to Buhari, the whole world was watching to see how Nigeria would uphold and strengthen its democracy by the conduct of the 2019 polls.

READ ALSO: Why I did not attend signing of peace accord with Buhari, others - Atiku

He said that the conduct of elections had been consistently marred by violence caused by the behaviour of the most sections of the political class and their supporters.

The president however said there were encouraging signs that the political class would embrace the responsibilities expected of it.

He said: “We are here to commit ourselves as key actors in the political process, party leaders and presidential candidates to a peaceful and credible conduct of the election.

“Today, we witness the formal and official signing of the peace accord by the presidential candidates of the parties contesting the next elections.

“We the candidates pledge to accord the highest tenets of conduct and encourage our teeming supporters to do the same.

“I wish to call on the INEC and all the security agencies to put the nation first in their conduct; the world is watching us and the task of building our country, institutionalising trust in our political system and institutions is fundamental to the growth and development of our country.’’

He said the essence of the gathering was to perform a very important part of the quest for a peaceful political process and to instill trust to various contestants.

According to him, given the central role good governance plays in the nation state, no society can develop without trust.

He said without the trust of the citizens on their government, there could not be a peaceful and progressive society.

“To gather this trust, there must be norms, rules those whose role is to offer guidance; some of them might cultural, moral or religious.

“However, for our society to function well, culture of rules and regulations must be enshrined and accepted by both the government and the people.

This is why there are constitutions, legislations and courts to mediate and regulate the conduct of citizens; the building of trust in our society is a collective duty and responsibility of all citizens.

“Today, our primary concern is to sign into norms, laws, guidelines that will guide the conduct of our national elections at all levels.

“ It is generally acceptable that democracy is the best form of government for any society; it is nonetheless, not a perfect system. In spite of its imperfections, democracy has come to stay in the world.’’

The president reminded that since 1999, Nigerians had enjoyed almost 20years of interrupted democracy.

He said that since the collapse of the Berlin Wall in 1989, democracy had spread to all over the world, including most unlikely places.

He said that with all its shortcoming, democracy was still the best form government for most developing nations.

He explained that elections were a large part of the process of democracy; methods of choosing leaders had become the most difficult for the people to manage for many reasons.

“We have not had a long tradition of democracy and so many changes in the system have made it difficult for us to imbibe the principles of democracy such as tolerance, sacrifice and commitment to processes,’’ he said.

He thanked NPC under the leadership of former Head of State, Retired Gen. Abdulsalami Abubakar for the sacrifices and good work it had done for the peace and progress of Nigeria.

Abubakar, in his address said the signing of the accord was crucial to ensuring peace during the campaigns and elections.

He told candidates that election would not hold unless there was peace and harmony in the country.

Delivering the keynote address, former Head of State Retired General Yakubu Gowon said that the number of political parties in Nigeria had grown to 91, adding that it was healthy for the country’s democracy.

Gowon said democracy could only thrive through persuasion and not by the use of force.

The News Agency of Nigeria (NAN) reports that presidential candidates of 73 political parties signed the accord while the candidate of Peoples Democratic Party (PDP) Atiku Abubakar was absent.

Meanwhile, Legit.ng had reported that President Muhammadu Buahri attended signing of the peace pact for 2019 presidential candidates which took place at the International Conference Centre.

Kogi lawmaker loses seat after dumping APC for PDP

- Linus Enenche’s seat in the Kogi House of Representatives was declared vacant after he defected to the PDP

- He said the issue has been taken to court describing it as illegal

- The lawmaker said his salary has not been paid in seven months

The Kogi State House of Assembly has declared vacant the seat of Linus Enenche, the member representing Olamaboro Constituency of the state.

The decision taken on Tuesday on the floor of the house in Lokoja followed the recent defection of Mr Enenche from the ruling All Progressives Congress (APC) to the main opposition party, Peoples Democratic Party (PDP).

READ ALSO: Breaking: Ex-governor, 3 gubernatorial candidates defect from PDP to APC

Mr Enenche lost his seat following a motion moved to that effect by the House Majority Leader, Bello Hassan Abdullahi.

Mr Abdullahi had hinged his motion on a letter transmitted to the House by the state Chairman of the APC, Abdul Bello, informing the House of Mr Enenche’s defection.

He said the letter also stated that Mr Enenche will be seeking a return to the house on the platform of his new party, the PDP during the 2019 elections.

By this action, Mr Abdullahi explained that Mr Enenche had contravened Section 109 -1 Sub Section G of the 1999 constitution as amended.

The motion was seconded by Ahmed Mohammed but a member of the PDP in the house objected on grounds that there was no evidence to back the motion.

He also argued that Mr Enenche had already dragged the APC to court over the matter.

The Speaker, Mathew Kolawole, however, overruled him and put the motion to vote.

Two of the three members present during the plenary voted yes while the only PDP member among them voted no.

Mr Enenche, who later spoke with journalists, described the action of his colleagues as reckless and unconstitutional.

The lawmaker who spoke on phone said that the matter was already in court, saying that declaring his seat vacant was null and void.

He alleged that the leadership of the House had refused to pay his salary and allowances for the past seven months.

Mr Enenche said all efforts made by him to get his entitlements released proved abortive as the Speaker claimed that he had been directed not to pay him.

- The United States said it is not endorsing any presidential candidate in Nigeria’s forthcoming election

- The US said it is up to the Nigerian people to decide who will be their next president

- It, however, said that it will be helping Nigeria’s electoral by supporting INEC and Civil Society Organisations

The United States of America has stated that it has no preferred presidential candidate in Nigeria’s 2019 general elections.

The Punch reports that Russell Brooks, the public affairs officer at the US Consulate General Lagos, said this via a live chat on Facebook.

When asked if the US would be supporting any presidential candidate ahead of the 2019 election, Brooks said the US would continue to remain neutral.

He said the only thing the US would be supporting is a credible and fair process.

“We are not favouring or supporting any candidate. It is up to the Nigerian people to decide. Our candidate is the process. The process should be free and fair, it should be a non-violent process. I am not talking of any plus or minus of any candidate, we are not favouring any candidate. We are not trying to influence the success of any candidate. That is not our role,” Brooks said.

He said the US would support the Independent National Electoral Commission (INEC), the media and Civil Society Organisations especially in the area of capacity building.

Brooks said: “We are helping Nigeria to make that progress through our support to INEC, to civil society here in Nigeria; through our assistance to the press and enabling them to also play a positive role in the coverage of the elections.”

Electoral Act: How Buhari saved Nigeria from chaos - BMO

$

- A pro-Buhari group has commended the president for rejecting the Electoral Amendment Act signed by the National Assembly

- The group said President Buhari's decision not to sign the bill is in the best interest of Nigeria’s democracy

- It also said the move to introduce a new law that redefines fundamentally the processes of elections is only setting a shaky foundation for the 2019 polls

The Buhari Media Organisation (BMO) says President Muhammadu Buhari has saved the country a chaotic electoral process by withholding his assent to the Electoral Act Amendment Bill.

The group said this in a statement jointly signed by its chairman and secretary, Messrs Niyi Akinsiju and Cassidy Madueke, respectively, on Tuesday, December 11, in Abuja.

It noted that Buhari’s decision not to sign the proposed law was in the best interest of Nigeria’s democracy.

“It is trite that the deployment of a new electoral law only two months to an election is a recipe for chaos.

“Introducing a new law that redefines fundamentally the processes of our elections is only setting a shaky foundation for the 2019 polls.

READ ALSO: 2019: We are not favouring or supporting any presidential candidate - US

“Also, with such fundamental changes such as the introduction of electronic transmission of results, and the compulsion in the use of the card reader without any remedy, among others.

“INEC staff would have to be trained and re-trained within two months, a period that is certainly not enough for that to happen,” the BMO said.

The group noted further that an ECOWAS Protocol on Democracy and Good Governance as well global best practices discourages any form of amendments or changes to electoral laws six months before any election.

While hailing the president for complying with democratic best practices, it added that it was no fault of Buhari that the leadership of the National Assembly delayed the amendment since mid-2017.

“The federal legislature had in the process of presenting the Bill for the President to sign in the last four occasions, made several unforgivable drafting errors.

READ ALSO: NAIJ.com upgrades to Legit.ng: a letter from our Editor-in-Chief Bayo Olupohunda

“At every point, he identified these errors and sent them back for corrections – and he was right every time.

“So much that the third time the National Assembly passed the Bill for the President’s signature, they had conspicuously and suspiciously removed the use of the card readers during elections.

The President sent it back and insisted that it be included,” it said.

The group also noted that the most recent amendment that the National Assembly sent to the president was not just late, but also contained grave drafting errors that if left to proceed would give room for rigging and manipulation of the results of elections.

BMO said: “Any attempt by some desperate unpatriotic Federal lawmakers to override the President’s veto would amount to a battle line being drawn between them and the Nigerian people, and their right to free and fair elections.

“We call on the National Assembly to ensure that the electoral processes are not toyed with for the self-serving interests of some of their colleagues.

“But rather ensure that the errors identified by President Buhari are looked into, rectified and sent back for his assent.

“The President would not do anything to hurt Nigeria’s democratic and electoral processes, as the last three occasions he sent the Bills back on grounds of grave errors, he was proved right when the National Assembly effected the corrections he proposed, and this time would not be different,’’ BMO said.

Meanwhile, Legit.ng previously reported that the North Central Democracy and Peace Vanguard, accused the National Assembly of a ‘plot’ against the country.

the group’s national president, Gabriel Agibi, said that Nigerians will hold the lawmakers solely responsible for any untoward development in the polity.

Agibi said the insistence on using "a faulty Electoral Law for the conduct of the election" by the National Assembly is a major trigger to foment trouble and cause widespread violent protests across Nigeria.

“Everyone was running to different directions with children crying for help. I learnt that we were under siege as gunshots rented the air. They were shooting people dead as they chased them on motorcycles.
